So, I have to intentionally violate my rights to invoke my rights?

If you don’t know what I’m talking about, SCOTUS came down with a decision today regarding the Berghuis v Thompkins case.  Thompkins was suspected of murder, read his Miranda rights, and remained silent for three hours while being questioned.  He was asked if he prayed for forgiveness for “shooting that boy down,” he answered “Yes.”

Long story short, he was convicted of murder then appealed the decision because he says his right to remain silent was violated by the continued interrogation – even though he sat silently for three hours.  His appeal was heard and conviction overturned – then it went to SCOTUS to decide.

First – I don’t see how his rights were violated since he specifically answered the question after three hours of silence.  He could easily have requested an attorney and the interrogation would have stopped.  The fact that he confessed rather than remain silent is his own undoing.

However, what pisses me off the most is the latest SCOTUS decision regarding this case – RARELY will you ever find me agree with a liberal – especially Sotomayor – but – the conservatives on the bench got this one completely wrong.

Here is what Kennedy said about this case

“Thompkins did not say that he wanted to remain silent or that he did not want to talk to police,” Kennedy said. “Had he made either of these simple, unambiguous statements, he would have invoked his ‘right to cut off questioning.’ Here he did neither, so he did not invoke his right to remain silent.”

Here is what Sotomayor said in the dissent

“Criminal suspects must now unambiguously invoke their right to remain silent – which counterintuitively, requires them to speak,” she said. “At the same time, suspects will be legally presumed to have waived their rights even if they have given no clear expression of their intent to do so. Those results, in my view, find no basis in Miranda or our subsequent cases and are inconsistent with the fair-trial principles on which those precedents are grounded.”

Holy crap!  I agree with her!  Here is what the Miranda states:

You have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to speak to an attorney, and to have an attorney present during any questioning. If you cannot afford a lawyer, one will be provided for you at government expense.

These rights are guaranteed by the Constitution.  The Miranda ruling only confirmed that arresting officers have to inform you of your constitutionally guaranteed rights.

So – to backtrack here – let’s get this straight… I have the right to remain silent…it says so right there in the Miranda.  I am being questioned and I sit silently during the entire questioning.  I have already stated I understood my rights.  I have explicitly expressed my right to remain silent by… wait for it…. being silent.

The infinite wisdom of the conservative idiots on SCOTUS now say I have to violate my guaranteed right to remain silent in order to state that I want to remain silent?  WTF?  As Sotomayor pointed out – once you have spoken, you have implicitly stated you do not want to invoke your right to remain silent.  By speaking to say you want to invoke your right to silence is actually telling the police you have already denied yourself that right by not being silent!

Thompkins should go to jail because he confessed.  He could have remained silent forever.  He didn’t have to tell the police he killed that kid – but – he did.  His conviction should not be overturned because his right to remain silent was violated – hell – he violated that himself by speaking up.  But – this idiot decision by SCOTUS is just that – idiotic. The invoked right of silence does not “cut off questioning” as Kennedy is assuming.  The invoked right to remain silent just means the suspect will remain silent.  If the suspect wants to have the questioning cut off – he needs to ask for a lawyer.

Hell must be freezing over for me to side with the liberal judge for once.

Is this Freaky Friday or something? Expanded Hate Crimes Bill?

Good lord, people.  Did I wake up this morning in an alternate universe?  I just read that those idiots in Congress expanded the hate crimes law (The Matthew Shepard Hate Crimes Bill) by attaching it to our defense budget for 2010.

Seriously?  What the fuck people? This has got to be another joke.  It has already been proven that the death of Matthew Shepard was a drug related.  His killers just wanted his money so they could buy drugs.

This is despicable.  This bill couldn’t pass on it’s own – so – they piggyback it with the needs of our military.  This bill is EXTREMELY dangerous in that it makes religious speech (a First Amendment Right) a federal crime if you oppose homosexuals.  Not only that, but it protects pedophiles.

This bill is completely unnecessary since there are already state laws in place for this (other than providing federal protection for pedophiles).  This is just more of those idiot liberals in D.C. pushing an agenda that the majority of America oppose.

I hope there is someone in D.C. with the balls to challenge this bill and bring it before SCOTUS.  Last time I heard there are supposed to be checks and balances in our government to prevent unconstitutional laws like this from passing.

I can’t wait for November 2010 to get here!

David – welcome back!  Haven’t seen you around in a while.  I take it you’re getting prepared for your college years now! LOL…enjoy them!  In this article, I found it interesting that you attributed the recession to “skyrocketing interest rates.”  Actually, I’m still waiting for them to increase.  In 1990 when I bought my first home, it was at an 11% interest rate – and that was normal back then.  My car loan was at 14% – again, normal in 1990.  I would hardly say our interest rates have “skyrocketed.”  With the prime lending rate still floating around 4% – I would say the cause of this recession has been the lack of the fed to stabilize the markets by actually, and truly, increasing interest rates.  If you want people to invest – you need to raise the interest rates.  The best I can get on my CD’s right now is 3.5% if I go out 3 years.  My Money Market is only earning 1% interest.  I remember in 1990 when I could get 10 – 12% on my short-term CD’s.  The best way for this economy to stabilize and to bring investors back in to the market is to raise interest rates.  So – if you want to attribute this recession to interest rates – I would actually attribute it to the falsely deflated interest rates.

“Fannie-Mae Healthcare” – sounds about right for this proposed monstronsity!  Let’s hope we garner enough support in the house to kill it right away.  The real solution is not “affordable health INSURANCE” – it’s affordable HEALTH CARE – Lower the cost of access to health care – i.e, through tort reform, and you open health care back up to free-market capitalism which is good for all.  Just providing insurance to everyone does nothing to lower the actual costs of healthcare. If anything – having this public option health insurance will just drive the costs up further.  Healthcare providers will increase their rates in order to cover the losses from that idiotic public plan.

Bwahaha!  Great title!  However, this is probably one of the best detailed posts regarding the “global warming” issue.  I’m with you – let’s hope there actually is an American Senator out there that is willing to ask the same questions as the Australian Senator and actually look at the facts rather than the myths before they vote on that economy killer of a bill.

Me – I say inflation is another necessary evil in a free-market capitalist system.  Inflation helps to stabilize the economy.  When you don’t allow inflation to occur and if you falsely keep interest rates down to try to curb inflation – you get what we have now – a serious recession leading towards a depression.  We could have avoided this had the Fed just allowed inflation to occur and run it’s natural course.  We wouldn’t be seeing the possibility of hyperinflation now.  In addition, when all these idiotic policies start hitting our economy – the price of everything will increase.  You are right though – If you follow your local prices at your local stores – you can see inflation creeping.  We should have seen this coming years ago.

Excellent video.  Who’s Jonathon Jarvis?  I’ve seen similar illustrations -but – this was by far one of the more simplistic and easiest to understand.  Highly recommended.

You do realize that by the MSM acknowledging the success – they would have to actually give credit to Bush, Cheney, and the entire Bush administration!  Since they can’t say this is a Democrat or Obama success – there’s no reason for them to report on it.  This withdrawal has nothing to do with Obama’s foreign policy as you have stated.  This withdrawal was agreed upon by Bush and Malaki last year.  So – why is there no reporting?  Because this is a conservative, republican, and Bush success. We know how Liberals and the liberal media hate to give credit to conservatives for anything.  Hell, Harry Reid and Obama both said last year that this war was lost.  Maybe that’s why the MSM doesn’t want to report on this success – it makes their Obamessiah look bad.

OH…this has nothing to do with ice cream does it? ;) But, I am in agreement with you on this one, being the Libertarian Conservative that I am.  Our forefathers did not intend for my favorite, Moosetracks, to be forced upon those who prefer vanilla. I believe you have the right to believe that your favorite is better than my favorite and we both have the right to disagree with each other without the government forcing us to choose one, such as what the Obama administration is doing with all of their policies.

Personally, I think that’s a load of crap.  The tax credit – not your article! :)   We don’t need any more freakin’ tax credits.  What we need is more permanent tax cuts.  The tax credit is not going to incentive anyone to buy a home in this market unless they can also come up with the 20% downpayment.  Many banks are actually going back to using solid business decisions and lending practices – that includes money down and income and employment verification.  The smart home-buyers are staying in the homes the are already in rather than risk the values of their homes going down further.  The market still hasn’t bottomed out.  Using my money to incentivize people to buy homes they may not really want or can’t afford is just another bad idea.  Kinda sounds like what caused the financial meltdown in the first place.

My Journey to Millions – A Guest Post – Ricci Reversal Rich!

Despite writing a personal finance blog, I enjoy chatting up politics and I think I have been very open about my political views, which are basically libertarian in nature. I generally believe the government is a necessary evil and as such I want to keep it as small as possible. The way I look at it I don’t want the government involved in my business affairs as much as I do not want them inhibiting what I (and the founding fathers) consider inalienable rights (by the way I just wrote that Retirement is not an inalienable right).

I dislike the idea of affirmative action in this Country in the year 2009, and truly believe how it is used today is not what Congress and the Supreme Court envisioned those many years ago.

Imagine sitting in a Constitution Law II class with half the room being women, a good portion of them Black, and a liberal liberal Professor – and you are a white Christian Male and you raise your hand to talk about reverse discrimination of white males. It was a scary time for My Journey…but I didn’t care and neither should you. Well today I got some reprieve!

Ricci v. DeStefano – The New Haven 20

Today the United States Supreme Court gave their Opinion (read: Decision) in the case of Ricci v.DeStefano. (opens a .pdf file) The Case surrounds a group fondly known as the New Haven 20, a group of 20 Firefighters who studied their a** off and did well enough on a test to get promoted, but the City of New Haven decided to throw out the exam because no African Americans did well enough on it. Yeah read that over again, seems almost unreal.

The Wall Street Journal wrote today,

Writing for a 5-4 majority in Ricci v. deStefano, Justice Anthony Kennedy said that the city of New Haven violated civil-rights law when it threw out firefighter promotional exams because more whites than blacks or Hispanics had passed the tests. New Haven claimed it had to junk the tests because certifying the results would lead to an avalanche of lawsuits by black candidates who hadn’t passed. In other words, the city claimed it had to intentionally discriminate against white candidates out of fear that the tests unintentionally had a “disparate impact” against minorities.

But the Court found no evidence that the tests were flawed or that better alternatives for promotion existed. On the contrary, employment tests are an important tool against the very kind of racial discrimination that civil-rights laws were designed to prevent. “Fear of litigation alone cannot justify an employer’s reliance on race to the detriment of individuals who passed the examinations and qualified for promotions,”

Justice Kennedy wrote. The Supremes created this “disparate impact” reverse discrimination incentive with its 1971 Griggs decision, since codified into law, but at least five Justices are still able to object to this kind of blatant racial injustice.

As a brother of a Firefighter (also white Christian Male) I have watched my brother study is butt off for the lieutenants’ test for the FDNY. My Brother has put as much work as I did for the New York State Bar Exam, and if my test was thrown out because some people, albeit minorities, did worse than me, I know I may be a ‘tad upset.’ Meanwhile, all this studying occurs while holding a full time job which includes running into burning buildings (as most law school graduates know – I didn’t do anything while studying for the bar except…study).

How this ruling will play out as we move forward will be interesting. Are we finally seeing an end to affirmative action? Probably not, but thankfully it may end the practice of just promoting minorities because of their ethnicity, color, and/or race (wow, doesn’t this seem like an MLK Speech?).

The Opinions (multiple Justices made statements) total about 93 pages, and were released Monday morning so I have not had the time read them, as such, I am not ready to start ripping on Sotomayor which has been going around the news lately. However, from the news stories I have read thus far, both the majority and dissent have been less than complimentary of the Supreme Court Nominee who was part of the lower court which was reversed.

Notwithstanding this post I don’t think a test would be fair if it only asked questions only whites knew the answer to, but that is notwhat happened in Ricci.

This absolutely is 100% proof that the media is so far in bed with government and government has taken control of the message. This shreds The First Amendment of the Freedom of the Press all to hell. But, with this administration…what else is new?  This is entirely one-sided since there will be no one there to present the other side of the debate.  No Republicans are allowed to be present or to speak on behalf of the opposition.  Again – Mr. Obama – where is this so-called “bipartisan debate” that you promised the country?

My country is going to hell in a handbasket and no one really seems to care about it.  How can we as Americans just stand by and allow the government to take over our national media like this?  This is one of the first steps that Hitler and Mussolini took when the state started taking over the lives of the people of those countries.  This also follows in the footsteps of Communist China, Russia, N. Korea, Iraq (Saddam Hussein), and Venezuela (Chavez).  Obama is controlling the message and the press is in the bag with him.  Seriously, what happened to the press being the watchdog over government as it was originally intended?

Is this what you guys on the left really voted for?  Really?  What makes you guys think you aren’t next?  If your agenda doesn’t fit with Obama’s statist positions – you can bet your voices will be stifled as well.

Not ALL great minds should think alike!

I’m not really sure what prompted this post today – but – nonetheless, it came to mind.  I’m sure all of us at one time or another have either said to someone else, or have had it said to them, “Great minds think alike.”  I’m not entirely sure that is applicable in today’s society and American culture.  I’ve been following Divided We Stand, United We Fall for quite some time now – he contributes to The BoBo Carnival of Politics frequently.

The premise of his blog is that we should keep the Federal government divided.  We should in no way ever allow a supermajority in the government as it will cause this great nation to fall, and fail.  No time like now has this ever been proven to be more correct.

Getting back to the original topic – if all “great” minds were to think alike we would never get anywhere, innovation would be stifled, and this country would not be as great as it is.  Think about it, what do you think would happen if everyone always agreed with everything?  There would never be discussion or debate about anything at all.  Sometimes, we might all reach an agreement on a subject that could be successful for all those involved.  However, the downside to everyone agreeing on a subject could just as well have negative consequences for all – i.e., cap-and-trade and global warming.

If the debate on global warming truly was over as Al Gorebecile would have us believe the thousands of scientists that were previously shunned wouldn’t be coming out now and providing all the evidence and proof that man-made global warming is nothing more than a hoax to advance the socialist agenda and to take American independence and freedom from us.

What I’m getting at is that the two-party system that has evolved in politics has now gotten to the point where no matter which party is in control – they are all thinking the same.  Our elected politicians no longer have the needs of America as their first priority.  The only thing that both the Democrats and Republicans care about is their own power and getting re-elected.  They will say and do anything and make all “promises” just to be re-elected so they can get their cushy jobs.

Both parties started off with opposing views and each had their constituents’ best interests in mind hundreds of years ago.  But, hundreds of years ago when this country was in its infancy Democrats were closer more libertarian and the Republicans were just a fraction to the left of them, but, still very much libertarian as far as what the government’s role was.  In fact, our country and its founding documents were based on “liberalism,” hence the term Liberty.  Conservatism, in the early founding of this country, referred primarily to conserving or protecting our culture, property rights, and economic liberties.

Today’s true conservatives and much of the libertarian point of view are closer to those of classic liberals – you know – our founding fathers.  Liberalism was hijacked by the progressives at the turn of the century in the early 1900′s right around World War I.  The Democrats and their general liberal positions were taken over by the radicals of the party.  As the Democrats were losing their true classic liberalism positions to the radical progressives, the Republicans began to adopt the position of the classic liberals and social conservatives at that same time, the birth of modern conservatism.

In my opinion, Ronald Reagan was our last true conservative President.  The only other political figure that remains what I consider to be a true conservative is Newt Gingrich.  (Don’t get me wrong, this is not a plug for Newt). All other politicians who identify themselves as Republicans have moved so far to the left that they may as well call themselves Liberal Democrats.  Essentially, our two-party system has evolved in to a one-party system of socialists that no longer care about America.  They all think alike now.

If you are either a Republican or a Democrat and you have found that your party no longer represents your values – the best solution now is to become an independent.  Many of my Democrat friends here in Florida are very much social and fiscal conservatives and have become disillusioned with their party.  Yet, they continue to vote down the party line because “all good Democrats never vote for a Republican.”  Conversely, many of my Republican friends here have become disillusioned with their party because the Republicans have abandoned their conservative principles.  They too vote down party lines because “We can’t let the Democrats have a majority.”  Theirs is more a vote out of fear.

The solution is to shed the parties and vote as an Independent or find one of the “third-parties” out their that is actually closer to your own values.  The Democrats and the Republicans are both taking America down the same path of destruction and none of them have a backbone any longer.  The two-party system is corrupt.  Regardless of which party may be in control – their votes are controlled by special interest groups.  Our representatives no longer represent the people of this country – they represent whoever gives them the most for their re-election campaigns.

It’s time for we regular everyday Joe Schmoe Americans to rise up and let D.C., local, and state politicians know that we want our country back.  If our votes don’t matter to them any longer they will no longer have our financial support either.  We will show them with our votes at the ballot box and we’ll reject everything they stand for.  We need to make them fear us.  They no longer fear losing their jobs.  Our system of government was not set up to have career politicians.  Those progressives amended our constitution to allow career positions and took the power from the States to be able to recall those Senators and Representatives.

We do have voices and we need to make those voices heard.  We need to put our constitution back in its place and restore State’s rights and the right for the people to recall their representatives back and hold elections to replace those who are not representing us.  The best way to do this at this point is to hold a constitutional convention.  We need to urge our Governors to join with the Governors of other states to hold such a convention.  We only need 2/3d of the states to implement a constitutional convention.  We don’t need the Senators & Representatives in D.C. to amend the Constitution.  We know there is no way in hell Congress would ever vote in term limits, restore state’s rights, or eliminate those freebie life-long benefits they have voted in for themselves.

I’m sure there are many on the ‘left’ who feel the government has overstepped its boundaries.  While we might not agree on exactly the “whats” what we do agree on is that government has gotten too big and too powerful.  It’s okay for us to disagree – that is what makes this country great.  I urge you to contact your governors as well.  Let’s reset this thing and put those in D.C. back in their places – as servants to the people.
