If this isn’t proof for those libbers that this bill has absolutely nothing to do with health care reform and all about controlling our lives – in addition to the fact you will go to jail for 15 years if you don’t purchase insurance – there is also language that would potentially force gun-owners to make a decision -

1. Don’t purchase insurance and go to jail for 5 years.

2. Keep your guns and pay higher premiums

3. Get rid of your guns so that you don’t have to pay the higher premiums.

Section 112: Wellness Program Grants

Essentially, this section provides grants to small employers who institute wellness programs as defined by the DHHS Secretary (Anti-gun Sebelius). She gets to make the rules as to what programs qualify. While the language isn’t in there yet – it can be – which I will illustrate shortly.

(a) ALLOWANCE OF GRANT.—

(1) IN GENERAL.—For purposes of this section, the Secretaries of Health and Human Services and Labor shall jointly award wellness grants as determined under this section. Wellness program grants shall be awarded to small employers (as defined by the Secretary) for any plan year in an amount equal to 50 percent of the costs paid or incurred by such employers in connection with a qualified wellness program during the plan year. For purposes of the preceding sentence, in the case of any qualified wellness program offered as part of an employment based health plan, only costs attributable to the qualified wellness program and not to the health plan, or health insurance coverage offered in connection with such a plan, may be taken into account.

So – there is the incentive for small employers – they can get up to $50,000 for instituting a wellness program in their offices.  So what is a qualified wellness program?

(1) QUALIFIED WELLNESS PROGRAM.—The term “qualified wellness program” means a program that —

(A) includes any 3 wellness components described in subsection (c); and

(B) is to be certified jointly by the Secretary of Health and Human Services and the Secretary of Labor, in coordination with the Director of the Centers for Disease Control and Prevention, as a qualified wellness program under this section.

(2) PROGRAMS MUST BE CONSISTENT WITH RESEARCH AND BEST PRACTICES.—

(A) IN GENERAL.—The Secretary of Health and Human Services and the Secretary of Labor shall not certify a program as a qualified wellness program unless the program—

(i) is consistent with evidence-based research and best practices, as identified by persons with expertise in employer health promotion and wellness programs;

(ii) includes multiple, evidence-based strategies which are based on the existing and emerging research and careful scientific reviews, including the Guide to Community Preventative Services, the Guide to Clinical Preventative Services, and the National Registry for Effective Programs, and

(iii) includes strategies which focus on prevention and support for employee populations at risk of poor health outcomes.

Having experience with “best practices and research” one needs to understand that there are already established studies out there, i.e “Youth Violence: A Report of The Surgeon General “ that states children are at risk if there are guns in their homes.  In addition to that report that comes out annually – there are hundreds of other public health studies that are anti-gun that attempt to show that gun ownership is a public health risk.  So – it is only a matter of the DHHS, CDC, and DOL deciding that guns are a public health risk and should be included – yes – they get to change the rules as they see fit:

(B) PERIODIC UPDATING AND REVIEW.—

The Secretaries of Health and Human Services and Labor, in consultation with other appropriate agencies shall jointly establish procedures for periodic review, evaluation, and update of the programs under this subsection.

So – there it is people. With everything else we have learned about this bill thus far – do you really want to trust this government having free reign to determine what is considered “acceptable behavior”?  This bill has absolutely nothing about reform health care – it is a total power grab and attempt of instituting a European-style nanny-state here in the U.S.  Please call your representatives and tell them this bill HAS to be shot down.  If you can visit them personally – that would be even better.

This is just one example – there are literally dozen’s of these wellness program grants that could be affected – check out this mess – this is the bureaucracy of this bill – you will have to click on it to enlargen to see it clearly – but – to the far right you will see the various “wellness programs” that fall under their purview that can be “updated.”  Feel free to steal this chart and put it up on your blog.

Here’s what they are trying to repeal:

The McCarren-Ferguson Act

Here is what this act does:

a United States federal law that allows state law to regulate the business of insurance without federal government interference.

This law was passed in 1945.  It expressly gives the states the authority to regulate all lines of insurance – not just health care.  The reasoning behind this is that the business of insurance is not commerce and therefore does not fall under the interstate commerce clause of the constitution. The federal government is only allowed to step in under federal anti-trust laws when there is a boycott, coercion, or intimidation or when the state is not actively regulating the insurance industry.  This Act upholds the 10th Amendment rights of the state as it reinforces that this is not a power given to the federal government and therefore it remains the rights of the states to regulate.

Once again, the Dems are trying to do everything and anything they can to grow the size of the federal government.  There is not a state in this country that does not currently regulate the insurance lines of business.  If the Dems can repeal this act they will have total control over the health insurance industry and will be able to regulate them out of business.  This is a backdoor approach to a single-payer government run universal healthcare system.

Here is the out for Congress that would give them the ability to repeal this act:

“In short, while not changing the opinion of prevailing law, the Court stated that the conclusion that insurance was not commerce under the law rested with Congress, and that the Court would follow the lead of Congress.”

So, essentially, all Congress would need to do is pass a law that says the business of insurance is commerce.  Once they do that, then the next thing they do is repeal this act.

Keep an eye on this folks.  They may not need to pass this economy killing faux health care reform bill if they can repeal this act.  It’s bad enough that since Obama was elected 30% of all private profit is now controlled by the federal government – why would anybody want to give this fascist government any more control?

Which leads to one more point – what the fuck is wrong with you libbers?  You call conservatives fascist because we believe in the free-market system and competition.  Yet, it’s your guy that is in bed with big business like no other president before?  He’s the real fascist and you are all in bed with him.  When you wake up one morning and realize you no longer have the freedom to choose what car you want to buy; what temperature you can set your thermostat at; what insurance plan you want; what foods you can eat and what beverages you can drink; what movies and television programs you can watch and what video games your kids can play; what radio programs you listen to; and what you can do and say on the Internet – you just remember – this was your choice and your own doing.

Yup – now the government is going to tell you what kind of TV you can buy.  What will be next?  And – you know what the payoff is for banning big-screen TV’s in California?

Whoop-de-fucking doo!  With today’s economy and with hyperinflation and increased interest rates coming around the corner – that $2.50 month savings can’t even by a loaf of bread! This is really getting out of control people.

A neat little story of how from Oct 19 – 25th there will be over 60 network shows that incorporate the administration’s message of “service.”  I’m telling you…this administration is all about “Big Brother” and they think they know what is best for you.  For the next week the major network shows and newscasts will be incorporating all of this administration’s agenda in to the broadcasts.  When have you ever heard of any administration controlling the entire freakin’ television and entertainment industry like this?

Taking this day off to spend with the family and to reflect on the greatness of this country, our history, and the future this administration is leading us too!  I’ll be back tomorrow.

Make sure you let those RINO’s know you will be actively campaigning against them when their time comes up. This will be their last term. This bill, if passed in the Senate, will strip a lot of our rights and choices from us and will increase taxes like crazy while redistributing the wealth to “low-income consumers” directly in to their bank accounts.

Next we need to focus on the Senators – hopefully we can kill it there.

Well, the good news is that someone out there has grown a pair and decided to challenge the constitutionality of the government takeover – if you haven’t heard about this yet – this would be a good one for you to follow as a follow-on to these posts of yours.  The Treasury Secretary of Indiana filed a lawsuit that is now headed to the Appeals Court.  The bailout was initially upheld in their district court.  The premise behind their lawsuit is that Indiana, as a GM bondholder (secured creditor), is entitled to 100% and should be paid out first.  This is definitely a good one!

Thanks for this history lesson re California.  I have contracts out in California and I can tell you that state is so confused it’s not even funny!  What’s amazing is that there are a lot of Conservatives in California – but – somehow the large concentration of liberals in the major cities always outweighs any conservative votes.  I’m surprised Conservatives still live there.  I think California can make a comeback as well.  Given the recent tax revolt out there – I think the people in that state are starting to wake up.  Unfortunately, as you pointed out, the Obama plan is following the California plan that drove them in to ruins.  We can only hope the rest of America wakes up before its too late.

I would say you knocked that one out of the park Allen.  I’m hoping there will be enough Republicans in D.C. to block this nomination.  As you rightly pointed out, because of her “experience” as a Latina woman – she will not judge by the rule of law.  She will judge just as Obama wants her to – with empathy.  We need someone who will be intellectually honest and will rule based on the constitution and will research the intent of the founding fathers as it relates to the case in front of him/her.  Sotomayor will not keep lady justice blind and she has pretty much said so.

I think you speak to the heart of the purpose of this Carnival.  All sides of an issue and discussion are welcome here.  I frequently travel through the liberal blogs to see what they are saying about the issues that I am writing about as well.  I believe you need to have both sides of any story before you can truly understand the issue.  I think you are correct in that we have to question everything.  If you never question – you become a sheep – blindly following along with the status quo.  I have on occasion agreed with the “opposition” after some concrete evidence has been presented.  However, what I see often on those “opposition” blogs are emotionally based opinions not based in fact at all.  I had a conversation with my wife just yesterday – I told her about an article I read about some idiot global warmongerer who blamed the Air France crash on global warming and how that kind of stuff really pisses me off.  She asked “Well, why do you listen to it if it pisses you off so much?” – And – that was pretty much my response – because I need to hear both sides.  Good post.

I always liked that song by Whitfield and Strong.  However, while I think you make some good arguments for our current “War on ….” I think what you forget is that this country became a strong independent nation from one single war – The Revolutionary War.  We are free Americans as a result of that war.  Sure – wouldn’t it be great if we could all live peacefully?  I certainly see your point on drugs, crime, and pre-marital sex – but – sometimes freedom and democracy comes at a very real price.

If the government had been doing their jobs up front with these TARP funds – there wouldn’t have been any bonuses.

I believe this is just one test among many that Biden was talking about.  You are absolutely right – Obama failed – especially by pointing to the U.N. to take care of the situation.  The U.N. is useless.  Newt was right – we should have taken out this missile before it even launched.  Unfortunately, Obama is all talk and rhetoric.  I don’t think he has the balls necessary to protect this country with our military might.

There are a couple other submissions this week regarding this same subject.  You have added some additional details and made some very valid points.  North Korea and Iran just really don’t give a shit.  They have consistently defied the U.N. VJack – while I can agree with you regarding the faith-based initiatives – (for the record, while being a Conservative Christian – I am in full agreement with keeping religion out of politics) – I don’t believe that Bush or his administration have committed any war crimes.  That will be a very hard one to prosecute as the President as the Command-in-Chief has very broad powers.  Also, the fact that he was given authority from Congress also points he fingers back at every single Dem who voted Aye on the resolution also has to be found guilty as well.

Also – just one thing – We told you so.  Obama was just fronting during the entire election.

As always, Archvillain – thanks for the great contribution to this carnival.  You hit the nail on the head with this post.  I’m hoping that people are starting to realize this.  It didn’t start with the Bush administration as many would believe.  I think this actually started going all the way back to Woodrow Wilson and each administration after that has just continued to erode our rights little by little.  I think there are more libertarian people in this country than they realize.  I think as people start reading history and really paying attention to politics – more are going to realize they are libertarians and will demand our freedoms back.

I’m not entirely sure Obama will awaken either considering the fact he is toying with the idea of allowing Iran to go forward with their nuclear ambition.  They just had their “grand opening” celebration of their first nuke plant this past week and no one said or did anything.  I believe that Obama is going to be even more dangerous for our national security than was Carter.  Great post.

Great synopsis.  When I heard that I was absolutely shocked.  I guess the only bright side of it is that 27% said they don’t know.  There actually is only 20% who absolutely say that socialism is better than capitalism.  Perhaps we can convice the other 27% they need to side with free-markets and capitalism.  I’m still apalled that there are 27% that don’t know.

I like the way that you broke those numbers down a little better to represent the over 40 crowd.  You would think those of us in that age bracket would overwhelmingly support capitalism versus socialism.  I think our liberal education system, as with you, as a major reason for this downward turn.  I can appreciate your discussion regarding the reason why socialism should be discouraged.  Good post Len.

I am always amazed with your writing and the discussions you post up.  I don’t believe this is crazy talk.  However, if we are going to see a global economic system – I would prefer to see one still based on the dollar.  It appears at this time the globe is moving away from it.  I would also hope that if there is a move to a global economic system – it remain on a democratic versus socialist government controlled system.

Interesting proposal there Aaron.  While I see where you are going with this – it also seems to stifle the “risk-reward” model of investments if you get the government involved to regulate trade.  I do agree there needs to be some oversight so that such a disaster could not happen again – but – I would suggest moderation as well.  I agree that information is the key.
